§ 42-7. Payment due date; penalties; imposition of liens; forfeiture of security deposit.

  • Payment of the fees provided for in this article shall be due the same date of each year as ad valorem taxes are due to the city. Failure to pay shall subject the property owner or the property owners' association to the same penalties provided for failure to pay ad valorem taxes. The fees charged for street lighting services shall constitute a special assessment on each property served by such services. The fees charged for street lighting services shall be added to the property owner or the property owners' association's ad valorem tax bill and shall constitute a lien on the property owned. Said liens shall have the same priority as tax assessments, and an execution may issue for the purposes of enforcing the lien including foreclosure and or judicial sale. Additionally, a property owners' association's failure to pay the fees provided for in this article shall forfeiture its security deposit and may result in the discontinuance of lighting service within the special assessment district. In the event the property owners' association fails to pay the fees provided for in this article, the next annual lighting charge for the special assessment district shall be levied in accordance with section 42-5(a).
