§ 50-332. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except when the context clearly indicates a different meaning:

    City manager means the city manager of the City of Flowery Branch or his designee.

    Egregious violation means an unauthorized usage of water, as determined by the city manager, which may impede providing water for essential services.

    EPD means the state department of natural resources, environmental protection division or its duly authorized representative.

    Essential services means health care, sanitation, cooking needs and fire protection.

    Noncompliance means having violated water usage restrictions. Noncompliance begins with the first violation and expires 12 months from the date of the first violation.

    Outdoor water usage means lawn and garden watering; noncommercial car washing; filling of private swimming pools; noncommercial pressure washing of building exteriors, sidewalks, or driveways; or any other outdoor water usage as determined by the city manager and/or the EPD.

    Violation means a usage of water other than what is authorized under water shortage management. Each day of unauthorized water usage will constitute a separate violation.

    Water shortage management is a program by which the city may restrict the usage of water by any or all users of the water system in order to protect and manage water resources.
